1999: Statutory Amendments

November 3rd, 2008

1999: Statutory Amendments. I.C. 32-28-3-5 is the pivotal statute. Subsection (b) provides that a mechanics lien is created when the lien notice is recorded. But the recorded lien relates back to the date the work began, which could pre-date a mortgage. In 1999, the General Assembly added the language now in subsection (d) that says construction mortgages have priority over mechanics liens if the mortgage is recorded before the notice of mechanics lien is recorded (not created). My reading is that subsection (d) disposes of Wards doctrine of parity, at least as to commercial and industrial projects. (Note that section 5(d)(1)-(3) has carve-outs for certain residential and utility projects.) Accordingly, courts should focus on relative filing dates, and not on work dates or contractor knowledge.

When you pick up your car rental, ask which parts of town to stay away from

November 2nd, 2008

When you pick up your car rental, ask which parts of town to stay away from. Staying away from high-crime parts of town could be the most important safeguard you can take. It is all too easy to inadvertently drive into bad neighborhoods when you are in a strange city, but with a little foresight and a decent map, it is just as easy to avoid them.

Most white collar crime investigations begin in secret

November 1st, 2008

Most white collar crime investigations begin in secret. The investigation may be triggered by a Qui Tam complaint alleging a violation of the state or federal False Claims Act. These complaints are filed under seal. Or the investigation may be triggered by an agency referral or a report from a complaining victim. During the covert stage of the investigation, the government may attempt to use undercover techniques such as consensual monitoring of conversations to elicit incriminating admissions. The government will use this period to develop probable cause to obtain a search warrant.

Hamilton’s second time lucky?

“I’m human. There’s nerves. Nerves of excitement and it’s never nerves of thinking you might fail. It’s just the adrenaline pumping and wondering whether you’ll get the start perfect, what’s going to happen in the first corner because it’s unknown. You have absolutely no clue about what’s going to happen – do you go left, do you go right, do you brake early, do you brake late, will you get hit from behind, will you get a flat tyre?”

Massa ready to crown maturity

In all the chauvinistic excitement surrounding Lewis Hamilton’s fight for the world championship it is easy to overlook the fact that Felipe Massa would be an equally worthy champion. October 12th, 2008

Meanwhile, the disgruntled folks formerly holed-up at the PNAC were now in control of the US government and military. Thanks to September 11, 2001, their dream of a retooled Middle East in the image of the US, or at least Israel, could be made into reality quicker and easier. Anyone looking at their planno doubt Bin Laden–had to ask the What If and What About questions: Can Afghanistan be pacified? What about Pakistan and its loyalty to Bin Laden? Will Turkey tolerate a Kurdistan? What if the Iraq occupation fails? What if the Shia take control? What about displaced Iraqis? What effect will displaced persons have on Syria, Jordan, and Saudi Arabia. Kuwait? What about Iran? What about Israel and the Palestinians? What about the Horn of Africa? What about the economic costs? What about our troops? What about history?
